The purpose of the Brownfields Program is to provide land owners the opportunity to have their property assessed for contamination at no cost. This program is aimed to help spur development on properties that may have been vacant for many of years, or are questionable as to if contamination exists. By having a Phase 1 and Phase 2 environmental assessment completed prior to purchasing, future and potential landowners are held harmless for any previous contamination if found. This is an assessment grant. Assessment grants provide funding for a grant recipient to inventory, characterize, assess, and conduct planning and community involvement related to brownfields sites.
When a site enters the program, the Brownfields/Voluntary Cleanup Program reviews existing site assessment reports and determines whether or not additional investigation or cleanup is required to meet state standards. The site investigation and any necessary cleanup are conducted by the applicant or their consultants and contractors. Site assessment reports, remedial action plans and a final report are submitted to the BVCP for review and approval.
When the BVCP is satisfied that the cleanup has met the objectives, the department provides the applicant with a Certification of Completion or No Further Action Letter. The department's Brownfields/Voluntary Cleanup Memorandum of Agreement with the Environmental Protection Agency state that the EPA will not plan or anticipate action relating BVCP sites after closure by the department.
Applicants pay for the BVCP's oversight costs, which are calculated on an hourly basis. Participation in the program is voluntary and applicants may withdraw at any time.
